Will Deuba Establish a House Majority Within 30 Days?

Following the Supreme Court’s , leader Sher Bahadur is expected to be sworn in as Prime Minister on Tuesday.

Deuba, the leader of the Nepali Communist Party, is on the verge of being appointed Prime Minister of Nepal. He must, however, demonstrate majority within 30 days. If he fails to secure a majority, the house will be dissolved and new elections will be held.

The writ filed by the 146-lawmaker strong opposition alliance was among those filed with the Supreme Court, demanding the reinstatement of the lower house as well as the appointment of Nepali Congress President as Prime Minister in accordance with Article 76 (5) of the Constitution.

The ruling was issued today by a five-member constitutional bench led by Chief Justice Cholendra Shumsher Rana, who stated that President Bidya Devi Bhandari’s decision to dissolve the House on Prime Minister KP Oli’s recommendation was unconstitutional.

In its decision validating Deuba’s claim, the Constitutional Bench issued a mandamus ordering Deuba to be appointed Prime Minister within two days. Similarly, an order has been issued for the House to be reinstated within days.
